Indonesia’s prosecutors have proposed an 18-year prison sentence for Nadiem Makarim, the former Minister of Education and founder of the “unicorn” Gojek. Makarim is accused of playing a crucial role in a corruption case involving the procurement of Google Chromebooks worth IDR 9.3 trillion (approximately USD 531 million).

Specifically, Makarim is accused of abusing his position to illegally gain IDR 4.8 trillion through directing the purchase of 1.16 million Chromebooks for schools from 2020 to 2022. This misconduct is also linked to agreements regarding Chrome Device Management (CDM) licenses.

Notably, this project was part of Indonesia’s Ministry of Education’s digital education program aimed at assisting students in remote and underserved areas during the COVID-19 pandemic. However, the program was later regarded as a disastrous failure due to the complete lack of internet access in the targeted regions.

This investment is believed to have increased Makarim’s personal wealth by IDR 809 billion in 2021 and surged by an additional IDR 4 trillion the following year.

“The defendant ignored the quality of elementary and secondary education to pursue personal gain,” declared chief prosecutor Roy Riady. “As a result, the defendant’s assets increased disproportionately, reaching IDR 4.8 trillion.”

Prosecutors now demand that Makarim repay IDR 4.8 trillion to the state budget; otherwise, he will face an additional 9 years in prison.

This proposed penalty is vastly higher than the initial estimate of budget damages (IDR 2.18 trillion). During the Tuesday hearing, a judge even suggested that the actual loss might amount to IDR 5.2 trillion due to inflated prices for computers and CDM license agreements.

Meanwhile, Makarim has continuously denied all allegations, claiming he is being slandered. He explained that the increase in his wealth is due to the surge in GoTo’s stock value (the entity formed from the merger of Gojek and Tokopedia) after its listing in 2022. He also emphasized that the Chromebook procurement was aimed at realizing the digital education vision of former President Joko Widodo.

The Chromebook case is one of many that observers believe reflects the criminalization of public policies in Indonesia. Three other defendants have been sentenced to about 4 years in prison each, including former tech consultant Ibrahim Arief. Another suspect, Jurist Tan (former Gojek director), is currently on the run.

Makarim is currently under house arrest for health reasons and recently underwent minor surgery. The next hearing is scheduled for June 2.
